Please read these Terms and Conditions carefully before using the mimap platform. By using our Service you acknowledge that you have read, understood, and agree to be bound by these Terms.
By accessing or using the MiMap platform ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and MiMap.
MiMap is a technology platform that connects customers seeking roadside assistance with independent third-party service providers ("Partners"). MiMap does NOT itself provide roadside assistance, towing, fuel delivery, lockout, jump-start, or any other physical services. MiMap acts solely as an intermediary marketplace and is not a party to any agreement between customers and Partners.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MIMAP, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO: (a) any act or omission of a Partner, including but not limited to negligence, misconduct, property damage, personal injury, or death; (b) delays, cancellations, or failures by a Partner to respond; (c) the quality, safety, or legality of services rendered by Partners; (d) your use or inability to use the Service; or (e) any unauthorized access to or use of your data. YOUR USE OF THE SERVICE AND ANY SERVICES ARRANGED THROUGH THE SERVICE IS AT YOUR SOLE RISK.
All Partners are independent contractors and are not employees, agents, joint venturers, or partners of MiMap. MiMap does not control the manner or means by which Partners perform services. MiMap makes no representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability, or availability of any Partner.
Subscription fees are billed on a recurring basis as described in the selected plan. All fees are non-refundable except as required by applicable law. MiMap reserves the right to modify pricing upon reasonable notice. Failure to pay may result in suspension or termination of your subscription. Subscriptions do not guarantee service availability in all areas or at all times.
Subscription plans include a limited number of service calls per year as described in the plan details. Additional services beyond plan limits may be subject to extra charges. Towing coverage is limited to 5 miles per incident unless otherwise stated; additional mileage will be billed separately. Fuel delivery service includes no mileage — mileage charges apply from point of dispatch. Lockout assistance includes no mileage — travel charges apply. Tire change includes travel up to 5 miles; additional mileage billed separately. Movego does not guarantee response times, as they depend on Partner availability and geographic location.
Quotes provided through the Junk Car service are estimates only and are not binding offers. Final offers are subject to vehicle inspection and may differ from initial estimates. MiMap is not responsible for the accuracy of quotes or for any transaction disputes between customers and junk car buyers.
Partners accepted into the MiMap network represent that they hold all required licenses, certifications, and insurance required by applicable law to provide the services they offer. MiMap reserves the right to remove any Partner at any time. MiMap does not verify, and is not responsible for verifying, the credentials, insurance, or qualifications of any Partner.
You agree to indemnify, defend, and hold harmless MiMap and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) any interaction between you and a Partner; or (d) any content you submit through the Service.
IN NO EVENT WILL MIMAP'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (a) THE TOTAL AMOUNT YOU PAID TO MIMAP IN THE 12 MONTHS PRECEDING THE CLAIM, OR (b) ONE HUNDRED U.S. DOLLARS ($100).
Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the state where MiMap is incorporated. You waive any right to a jury trial or to participate in a class action lawsuit or class-wide arbitration.
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which MiMap is incorporated, without regard to its conflict of law provisions.
MiMap reserves the right to modify these Terms at any time. Changes will be posted to this page with an updated effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
MiMap may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, all provisions of these Terms that by their nature should survive termination shall survive, including but not limited to disclaimers of liability, indemnification, and dispute resolution.
